Terms of Service
1. Who we are and what these terms cover
These Terms of Service ("Terms") govern your use of Pharosite, a website monitoring service operated by Georgios Chreiazomenos (ΧΡΕΙΑΖΟΜΕΝΟΣ ΓΕΩΡΓΙΟΣ), a sole proprietorship registered in Greece, VAT number EL066364326, 17 Nikou Xylouri, 71307 Heraklion, Crete, Greece ("Pharosite", "we", "us").
The Service consists of the Pharosite dashboard, its API, the optional Pharosite agent and the alerts and reports we send. "Customer" or "you" means the business that opens an account; you accept these Terms on its behalf and confirm you are authorised to do so. Pharosite is a service for businesses.
Our Privacy Policy explains how we handle personal data about you. Our Data Processing Agreement ("DPA") forms part of these Terms and governs personal data we process on your behalf.
2. Your account
- You must give accurate information and keep it up to date. The account owner may invite team members; you are responsible for everything done through your account, its members and its API keys.
- Keep passwords, recovery codes and API keys confidential. Tell us promptly at [email protected] if you suspect they have been compromised. We strongly recommend two-factor sign-in for every member.
3. Sites you may monitor
- You may only add websites that you own or that you are authorised in writing to monitor. Before we probe a domain, you must prove control of it (DNS record, file or meta tag). If that proof lapses, monitoring stops.
- Monitoring sends automated requests to your sites from our servers, at the intervals you choose within your plan. You are responsible for making sure your hosting, firewall and any third-party terms allow that traffic.
- Journeys (scripted checks in a real browser, such as a checkout or a booking search) act on your site as a visitor would. You must use test accounts, test products or test payment methods so that a journey creates no real orders, charges or bookings. Any logins you store for journeys must be for accounts created for that purpose. You are responsible for the effects of a journey you configure.
4. The Pharosite agent and WordPress updates
- The agent is optional software you install on your own site or server. It reports the software versions installed and, only after a member of your account approves a proposed change, performs that WordPress update. Pharosite never connects to the agent and cannot change your site without that approval.
- Updates can fail or break a site, even when they are checked afterwards and rolled back automatically. Before approving a change you are responsible for having current backups of your site and database. To the extent permitted by law, we are not liable for the consequences of an update you approved.
- You may remove the agent at any time; revoking it in the dashboard stops it from receiving work.
5. What the Service does and does not promise
- Pharosite checks your sites from outside, at intervals, and alerts you through the channels you configure. It cannot detect every problem, and alerts can be delayed or lost because of third parties (email, SMS, Slack, Microsoft Teams, network providers). The Service supports your own operations; it does not replace them.
- Security findings, including known vulnerabilities in WordPress, plugins and themes, come from third-party sources such as the U.S. National Vulnerability Database and Wordfence Intelligence (© Defiant, Inc., used under its licence; CVE data © The MITRE Corporation). They may be incomplete or wrong. A finding of "unknown" or the absence of findings does not mean a site is secure. Copyright notices and links shown with a finding must be kept with it.
- We aim for high availability, but unless a separate service level agreement is signed we give no uptime commitment.
6. Acceptable use
You must not, and must not let anyone else:
- monitor, test or send requests to any site or system you are not authorised to monitor;
- use the Service for load testing, denial of service, vulnerability scanning of third parties, scraping, or getting around access controls;
- store, through the Service, logins or content you have no right to use;
- break the law, infringe others' rights, or send unlawful or unsolicited messages through our alert channels;
- try to access other customers' data, probe our systems for vulnerabilities without our written permission, or interfere with the Service;
- resell, sublicense or provide the Service to third parties, except to clients whose sites you manage as an agency;
- copy, decompile or reverse-engineer the Service, except where the law allows it.
We may suspend checks or accounts that break this section, if possible after telling you, and immediately where needed to prevent harm.
7. Plans, fees and payment
- Each plan sets limits such as the number of sites and checks and the shortest check interval. Your plan and its limits are shown in the dashboard. You can move to a smaller plan in the dashboard; to move to a larger plan, contact us.
- Fees are billed monthly or yearly in advance, as you choose, in euros, excluding VAT, and are payable by the payment method offered when you subscribe.
- Right of withdrawal: you may cancel a new subscription within 14 days of its start, by writing to [email protected], and we will refund what you paid for it within 14 days of your request. This follows the EU rules on distance contracts and applies to every customer, whether or not you are a consumer. After those 14 days, fees already paid are not refunded, except where the law requires it or these Terms say otherwise.
- If a payment fails, monitoring continues for a 14-day grace period. If it is still unpaid after that, we may suspend monitoring until payment is made.
- We may change prices with at least 30 days' notice. The new price applies from your next billing period; you may cancel before then.
- During the private preview the Service may be provided free of charge; these terms on fees apply once paid plans start.
8. Your data
- You own the data you put into the Service and the results generated about your sites ("Customer Data"). You give us the rights needed to host, process and display it in order to provide the Service, as set out in the DPA.
- You are responsible for having a lawful basis for any personal data in Customer Data, including data that may appear in screenshots of your pages or in emails your sites send to our test addresses.
- We may use aggregated, anonymised information about how the Service performs (for example check volumes and error rates) to operate and improve it. It never identifies you or your sites.
- You can export your data through the API at any time while your account is active.
9. Our intellectual property
The Service, including its software, the agent, documentation and branding, belongs to us or our licensors. We give you a non-exclusive, non-transferable right to use it during your subscription under these Terms, and to install the agent on sites and servers you control for that purpose. If you send us feedback, we may use it without any obligation to you.
10. Confidentiality
Each party will keep the other's non-public information confidential, use it only for these Terms, and protect it with at least reasonable care. This does not apply to information that is public through no fault of the receiving party, already known to it, or independently developed, nor to disclosures required by law.
11. Warranties
To the extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that it will detect every outage, defect or vulnerability, or that alerts will always arrive. Any statutory warranties are excluded to the maximum extent the law allows.
12. Limitation of liability
- Neither party is liable for indirect or consequential loss, or for loss of profit, revenue, sales, business or data, even if it was foreseeable, including lost sales during an outage that the Service did not detect or report.
- Each party's total liability under these Terms in any 12-month period is limited to the fees you paid for the Service in that period, or EUR 100 if greater.
- Nothing in these Terms limits liability for intent (dolus) or gross negligence, for death or personal injury, or any liability that cannot be limited under Greek law (including Article 332 of the Greek Civil Code).
13. Indemnity
You will compensate us for claims by third parties, and the reasonable costs of defending them, arising from sites you monitored without authorisation, journeys or updates you configured or approved, or your breach of section 6.
14. Term, suspension and termination
- These Terms apply from when you open an account until it is closed. You may close your account at any time; apart from the right of withdrawal in section 7.3, paid periods are not refunded unless the law requires it.
- We may end these Terms with 30 days' notice, refunding any fees paid for the period after termination. Either party may terminate immediately if the other seriously breaches these Terms and does not fix the breach within 14 days of notice.
- When the account closes, monitoring stops. You can export your data before closing, and we delete Customer Data within 30 days, except where the law requires us to keep it. Backups are overwritten within a further 30 days.
- Sections 8.3, 9, 10, 11, 12, 13 and 16 survive termination.
15. Changes to these Terms
We may update these Terms. We will tell account owners by email at least 30 days before a material change takes effect. If you do not agree, you may close your account before then; continuing to use the Service afterwards means you accept the change.
16. General
- Governing law and courts. These Terms are governed by Greek law. The courts of Heraklion, Crete, have exclusive jurisdiction, without affecting any mandatory rights you have under the law of your own country.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, including outages of the internet, hosting or third-party services.
- Assignment. You may not transfer the account without our consent. We may transfer these Terms as part of a merger or sale of our business, with notice to you.
- Entire agreement. These Terms, the DPA and any order form are the whole agreement between us about the Service. If a provision is invalid, the rest remains in force.
- Notices. We send notices to the account owner's email address. Send yours to [email protected].
- Language. These Terms are written in English. If we publish a translation, the English version prevails.
